Terms of Service
When using Forsyth-Online's services, you agree to the terms and conditions listed on this page (the "Terms of Service"), which may be updated by us from time to time. The Terms of Service apply to Forsyth-Online, its parent and subsidiary sites, third-level domains, parked domains, partnerships and affiliates, owner, and individuals employed or contracted by Forsyth-Online or its owner except where otherwise noted.

Forsyth-Online may provide search technology that links to other Web sites or static or database-generated links to other Web sites and information located worldwide throughout the Internet. Because we have no control over such sites and information, we make no guarantee as to such sites and information, including the accuracy, currency, content or quality of any such sites and information and we assume no responsibility as to whether the search locates unintended or objectionable content. Furthermore, because some content on the Internet consists of material that is adult-oriented or otherwise objectionable to some people, the results of links on our sites may automatically and unintentionally generate links or references to objectionable material. We make no claim that such surprises might not occur.

Under Forsyth-Online's privacy policy, we may disclose to third parties certain aggregate information contained in our users' registration applications, but we will not disclose your name, address, email address or telephone number without your prior written consent, except as required by law.

You are responsible for maintaining the confidentiality of your account number, user name and/or password. You are responsible for all uses of your account, whether or not actually or expressly authorized by you. You must be 18 years of age or older to open or maintain an account, free or otherwise, with Forsyth-Online or to access any part of the site which requires an account or registration of any kind or to enter any personal information into any form or to create or maintain any personalized settings that may be available on Forsyth-Online.

In order to ensure that Forsyth-Online is able to provide high quality services that are responsive to customer needs, you must consent to Forsyth-Online employees being able to access your account and records on a case-by-case basis to investigate complaints or other allegations or abuse. Forsyth-Online shall not disclose the existence or occurrence of such an investigation unless required by law. Violation of terms of service may result in immediate deletion of a users account.

All chat and bulletin board communications are public and not private communications. Although we reserve the right to remove without notice any bulletin board posting for any reason, we have no obligation to delete content that you may find objectionable or offensive.

All chat, bulletin board, email, or other communications with Forsyth-Online become the property of Forsyth-Online for nonexclusive use without restrictions unless said communications are directed at Forsyth-Online in private email format for the sole purpose of conducting business with Forsyth-Online to the extent that Forsyth-Online is a service provider.

Forsyth-Online may provide links to merchant's websites to assist User's shopping online. Merchants are obligated to provide accurate and current information to Forsyth-Online at all times, however in certain circumstances it is possible that a merchant may update it's website information before it provides updated information to Forsyth-Online. By using this service you agree to be aware of this risk. Forsyth-Online is not involved in any transaction between any user of our service and any merchant who you might find while using our service; for this reason any question you might have with the merchant must be taken directly to the merchant.

We may modify or discontinue our services or your account with us, with or without notice, without liability to you, any other user or any third party. We reserve the right to terminate your account if we learn that you have provided us with false or misleading registration information, interfered with other users or the administration of Forsyth-Online's services, or violated these Terms of Service. We may block your access to Forsyth-Online with no prior notice and by using any means at our disposal. In addition, some areas of Forsyth-Online may be made inaccessible to you based on criteria not specific to your account, including your browser type, operating system type, or other general criteria.

You understand and agree that Forsyth-Online's services are provided "AS-IS". Forsyth-Online assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

FORUMS AND PUBLIC COMMUNICATION
"Forum" means a chat area, message board, instant messaging, mobile messaging or e-mail function (including, but not limited to, electronic greeting cards) offered as part of Forsyth-Online. If you participate in Forsyth-Online’s forum, you agree to follow our terms set forth below.

You acknowledge that anything you submit to is routed through Forsyth-Online servers and the Internet and that, therefore, you have no expectation of privacy with regard to any such submission. You acknowledge that the Forums and features on Forsyth-Online are forums for public and not private communications. Please keep in mind that whenever you give out personal information online, for example, via message boards or chat, that information can be collected and used by people you don't know. We cannot guarantee the security of any information you disclose online; you make such disclosures at your own risk.

Users or visitors shall remain solely responsible for the contents of the messages they communicate when using our services and as well as the consequences of any such messages. You take responsibility for postings under your username and use the information provided in the Forums at your own risk. We reserve the right to remove or edit content from any Forum at any time and for any reason although we have no duty to do so.

You agree that you will not use our services for chain letters, junk mail, "spamming" or commercial solicitations or to engage in illegal activities. You further agree not to use our services to send any message or material that is unlawful, gives rise to civil liability or otherwise violates the community standards described on our sites.

When participating in a Forum, never assume that people are who they say they are, know what they say they know, or are affiliated with whom they say they are affiliated with in any chat room, message board, or other user-generated content area. Information obtained in a Forum may not be reliable, and it is not a good idea to take any action, including to trade or make any investment decisions, based solely or largely on information you cannot confirm. We cannot be responsible for the content or accuracy of any information, and shall not be responsible for any trading, investment, or any other decisions made based on such information.

HOUSE RULES

The following is a list of the House Rules of conduct for Forsyth-Online forums. You agree not to do any of the following:

1. Post, distribute, or otherwise make available or transmit any data, text, message, or computer file that we deem to be: (a) defamatory, abusive, harassing, insulting, threatening, or that could be deemed to be stalking; (b) bigoted, hateful, or racially offensive; (c) vulgar, obscene, or sexually explicit (language or images); or that (d) encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them;

2. Post, distribute, or otherwise make available or transmit any data, text, message, computer file, or other material that infringes and/or violates any right of a third party or any domestic or international law, rule, or regulation, including but not limited to: (a) copyright, patent, trademark, or other proprietary rights; (b) right of privacy (specifically, you must not distribute another person's personal information of any kind without their express permission) or publicity; (c) any confidentiality obligation;

3. Advertise or sell any products, services or otherwise (whether or not for profit), or solicit others or use any Forum for commercial purposes of any kind,

4. Post, distribute, or otherwise make available or transmit any software or other computer files that contain a virus or other harmful component;

5. Impersonate any person or entity or misrepresent your identity or affiliation with any person or entity;

6. Engage in antisocial, disruptive, or destructive acts, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet;

7. Delete any legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, or modify any logos that you do not own or have express permission to modify;

8. Post, distribute, or otherwise make available or transmit material or make statements that do not generally pertain to the designated topic or theme of any Forum.

We reserve the right to remove any material, and if we deem appropriate, to turn over to law enforcement officials, any material, including message, e-mail, or posting, that is in violation of these House Rules. We also reserve the right to remove messages, e-mails, or postings that do not pertain to the designated topic or theme of the Forum.

We also reserve the right to comply with any order or otherwise cooperate with law enforcement officials regarding the identification of any user alleged to be using Forsyth-Online in violation of the law.

YOU UNDERSTAND AND EXPRESSLY AGREE THAT USE OF FORSYTH-ONLINE'S SERVICES ARE AT YOUR SOLE RISK, THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF FORSYTH-ONLINE'S SERVICES IS AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.

EXCEPT AS EXPRESSLY SET FORTH ON OUR SITES, FORSYTH-ONLINE DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT AND IT MAKES NO WARRANTY OR REPRESENTATION REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF FORSYTH-ONLINE'S SERVICES, REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH FORSYTH-ONLINE'S SERVICES, REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH FORSYTH-ONLINE'S SERVICES, REGARDING ANY TRANSACTIONS ENTERED INTO THROUGH FORSYTH-ONLINE'S SERVICES OR THAT FORSYTH-ONLINE'S SERVICES WILL MEET ANY USER'S REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE.

FORSYTH-ONLINE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE FORSYTH-ONLINE'S SERVICES, RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH FORSYTH-ONLINE'S SERVICES, RESULTING FROM LOSS OF, UNAUTHORIZED ACCESS TO OR ALTERATION OF A USER'S TRANSMISSIONS OR DATA OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF FORSYTH-ONLINE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend and hold harmless Forsyth-Online, its affiliates, officers, directors, employees, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of our services, your violation of the Terms of Service or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. The Terms of Service will inure to the benefit of Forsyth-Online's successors, assigns and licensees.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service may be changed or edited from time to time without notification or approval of any party other than Forsyth-Online. It is the user's responsibility to make note of changes. If you wish to make your own changes the Terms of Service, all you have to do is buy Forsyth-Online.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by Forsyth-Online.
